Caught having sex in woods can the cop record it?

me and my girlfriend were having sex in the oods and a cop had caught us they recorded it for evidence im guessing were under 18. were both 16 so would that be child porn we both had got summoned for indecent conduct whats the most court will do i am on pprobation
